High court directs state to reconsider election officer for GTA elections

By a staff reporter-In the matter filed by the Gorkha National Liberation Front (GNLF) challenging this notification appointing an Election Officer for the purpose of conducting elections to the Gorkhaland Territorial Administration (GTA), (Darjeeling Hills) the Hon’ble Justice Rajasekhar Mantha, High Court at Calcutta, was pleased to direct the State Govt to reconsider the decision in light of the Supreme Court order asking the High Court to first decide the question of legality/ vires of the Gorkhaland Territorial Administration Act, 2011, & the Memorandum, inasmuch as any election involves spending huge amount of public resources. The matter has been posted for further hearing on 21.6.21, when the hearing pertaining to Constitutionality would be heard. Incidentally, GNLF & Subhas Ghisingh, had filed a writ petition in 2012 challenging the Constitutionality of the GTA Act, 2011, which is pending adjudication.
